1. What Information Do We Collect?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, when you place an order, or otherwise when you contact us. This may include:
- Contact information: name, email address, phone number, and shipping address.
- Order information: product selections, custom build specifications, and order history.
- Payment information: we collect data necessary to process your payment, such as your payment instrument number and billing address. All payment data is processed and stored by our payment processor, Stripe; we do not store complete payment card information.
- Communication data: information you provide when you contact us, including support requests and custom build inquiries.
Sensitive Information. We do not process sensitive information.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information - such as your Internet Protocol (IP) address and/or browser and device characteristics - is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, country, location, and information about how and when you use our Services. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. Like many businesses, we also collect information through cookies and similar technologies.
We also measure how our pages are used - including the number of views a page receives, the approximate time visitors spend on a page, and how far down a page visitors scroll - using anonymous, cookieless, first-party measurement. This measurement stores nothing on your device and uses no persistent identifiers: the technical values involved are irreversibly hashed with a key that changes every day, so the resulting statistics cannot identify you or follow you across days or across other websites. If your browser sends the Global Privacy Control (GPC) signal, we honor it and this measurement is not performed for your visit.
2. How Do We Process Your Information?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To process and fulfill your orders, including custom build requests.
- To provide customer service and support, respond to your inquiries, and handle warranty claims.
- To authenticate you and manage access to order tracking and any account-based portal (we use passwordless magic-link sign-in).
- To process your payments securely through our payment processor.
- To send you administrative information, such as order confirmations and shipping updates.
- To send marketing and promotional communications, where this is in accordance with your preferences. You can opt out at any time.
- To improve our website and Services and to understand how they are used, through internal, first-party analytics.
- To detect and prevent fraud and to protect the security of our Services.
- To comply with our legal obligations and to enforce our terms and policies.
3. When and With Whom Do We Share Your Personal Information?
In Short: We may share information in specific situations described in this section and/or with the following categories of third parties. We do not sell, rent, or trade your personal information.

- Email delivery providers (to send transactional and, where permitted, marketing emails).
- Website hosting and cloud data storage (to operate our Services and securely store data).
- Bot-protection and security providers (to protect our forms and Services).
These providers are contractually obligated to protect your information and use it only for the purposes we specify.
We may also need to share your personal information in the following situations:
- Legal requirements. We may disclose your information where required to do so by law, or in response to valid legal process, or to protect the rights, property, or safety of Optimist, our users, or others.
- Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

4. Do We Use Cookies and Other Tracking Technologies?
In Short: We may use cookies and other tracking technologies to collect and store your information.
We use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services, prevent crashes, fix bugs, save your preferences, and assist with basic site functions. Non-essential analytics are loaded only after you grant consent.
Specific information about how we use such technologies, the categories of cookies we use, and how you can refuse certain cookies is set out in our Cookie Policy.
5. How Do We Handle Your Social Logins?
In Short: Our Services do not currently offer registration or login through third-party social media accounts.
We do not offer the ability to register or log in using a third-party social media account (such as Facebook, Google, or X). Sign-in to order tracking and any account-based portal is handled through a passwordless, single-use magic link sent to your email address. If we add social login in the future, we will update this Privacy Policy accordingly.
6. Is Your Information Transferred Internationally?
In Short: We store and process your information in the United States.
Our servers and operations are located in the United States. Optimist currently sells and ships within the United States only. If you access the Services from outside the United States, please be aware that your information may be transferred to, stored by, and processed by us and the third parties with whom we share personal information in the United States.
If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, these countries may not necessarily have data protection laws as comprehensive as those in your country. We will, however, take all necessary measures to protect your personal information in accordance with this Privacy Policy and applicable law.
7. How Long Do We Keep Your Information?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Policy unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, warranty, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
8. Do We Collect Information From Minors?
In Short: We do not knowingly collect data from or market to children under 18 years of age.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at support@optimist.gg.
9. What Are Your Privacy Rights?
In Short: Depending on your state or country of residence, you may have rights that allow you greater access to and control over your personal information.
Depending on your location, you may have the right to: request access to and obtain a copy of your personal information; request correction of inaccurate or incomplete information; request deletion of your personal information (subject to legal retention requirements); object to or request restriction of the processing of your personal information; and, where processing is based on consent, withdraw that consent at any time.

You also have the right to lodge a complaint with your local data protection authority.
10. Controls for Do-Not-Track Features
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.
11. Do We Make Updates to This Policy?
In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws.
